Ngày 5/10, Tối cao Pháp viện mở màn nhiệm kỳ mới bằng phiên tranh luận về việc liệu luật liên bang có ngăn cản các chính quyền địa phương khởi kiện tập đoàn dầu khí để đòi bồi thường thiệt hại do biến đổi khí hậu hay không.

**Vì sao đáng chú ý:** Kết quả vụ kiện giữa thành phố Boulder (Colorado) với ExxonMobil và Suncor có thể định đoạt số phận hàng chục vụ kiện tương tự trên toàn quốc, nơi các địa phương yêu cầu ngành năng lượng chi trả hàng tỷ đô la cho các thảm họa khí hậu.

- Quận và thành phố Boulder khởi kiện hai công ty ExxonMobil và Suncor Energy từ năm 2018 theo luật tiểu bang, cáo buộc các tập đoàn này lừa dối công chúng về tác hại môi trường và đòi bồi thường chi phí đối phó cháy rừng, hạn hán.
- Các hãng dầu khí cùng chính quyền Trump lập luận rằng vấn đề ô nhiễm xuyên bang thuộc phạm vi của Hiến pháp Mỹ và Đạo luật Không khí Sạch (Clean Air Act), nên tòa án tiểu bang không có thẩm quyền giải quyết.
- Thẩm phán Samuel Alito rút khỏi vụ kiện do sở hữu cổ phiếu tại hai công ty năng lượng khác, khiến hội đồng xét xử chỉ còn 8 thẩm phán tham gia phiên tranh tụng.
- Nếu 8 thẩm phán chia phiếu tỷ lệ 4-4, phán quyết trước đó của Tối cao Pháp viện Colorado sẽ giữ nguyên hiệu lực và cho phép vụ kiện của Boulder tiếp tục tiến hành tại tòa án tiểu bang.
